1. Validity:

The following terms and conditions are valid for all sellings, deliveries and services of tanala-store.com. Any other terms and conditions which differ from ours are not valid, even if we carry out an order without contradicting those different conditions.

All online prices are cash payment prices and include the German value-added tax.

4. Guarantee:

We offer a two-year guarantee. Please send us in case of guarantee issues an email. We will inform you about all warranty processes.

5. Return / Power of revocation:

1. Customers are able to withdraw a contract without any statement about a reason by a writen document (e.g. letter, fax, email) or by returning the articles within 14 days. In case of articles which cannot be dispatched by parcel delivery an information about the return will be sufficient. The period will start earliest with the receipt of this explanation. For the protection of the period the punctual disptach of the withdrawal or article will be sufficient. You have to conatct:
1. Verbraucher können ihre Vertragserklärung innerhalb von 14 Tagen ohne Angaben von Gründen in Textform (z. B. Brief, Telefax, e-Mail) oder durch Rücksendung der Ware widerrufen. Bei nicht paketversandfähigen Waren genügt die Absendung eines Rücknahmeverlangens. Die Frist beginnt frühestens mit Erhalt dieser Belehrung. Zur Wahrung der Frist genügt die rechtzeitige Absendung des Widerrufs oder der Sache bzw. des Rücknahmeverlangens. Widerruf bzw. Rücknahmeverlangen und Warenrücksendung sind zu richten an:

2. consequences of withdrawal/ return: In case of an effective withdrawal/ return all services have to be returned and any  received advantages have to be surrendered. In case of a deterioration of the articles we can demand compensation. This does not concern the leaving of articles if the deterioriation is attributed to the articles' examnination - like it would have been possible in a shop. You can prevent a compensation by not using the articles as an owner would do and by omitting every action which would  reduce the article's value. Products that can be dispatched by parcel delivery are to be send back at our cost and risk. In case of a return of a sending whose value is not more than 40,00 EUR you have to bear the delivery costs if the delivered articles correspond to the formerly ordered ones. Otherwise you do not have to pay anything with one exception: if the ordered articles were not fully paid at the time of the withdrawal. In this case you have to bear the costs for the return. Articles which cannot be send via parcel delivery are fetched up at our costs and at our own risk. 
 
3. The power of  revocation and return is not valid for exceptional cases which were dealt with by law, especially not in cases of contracts: the delivery of  products which were specially produced for a customer or are designed for the special needs of a customer or products which cannot be dispatched by parcel delivery due to their special state. According to that this exception also concerns the delivery of  audio or video recordings and software if the seals have been taken off. 

6. Shipping charges and address of delivery:

The address of delivery for user orders has to be the residence of the customer. You can see the shipping charges at our current table which refer to a delivery within Germany. The dispatch takes place via payment in advance. Although we will give our best to deliver punctual all delivery deadlines are not binding. Partial deliveries will be dispatched in our own estimation if there have not been a special notice by the customer.

7. Refusal of acceptance:

In case of a refusal of acceptance without a written order cancellation we will charge you with 10,- EUR.

8. Power of guarantee:

tanala Foto GmbH, called in the following text  tanala-store.com.

8.1 tanala-store.com agrees to, on the statutory guarantee, to take responsobility of all articles delivered by tanala-store.com. The warranty for used articles is 12, for new articles 24 months in case of user orders. In case of company orders the warranty is 12 months for all articles. The warranty period starts with the receipt of the articles.

8.2 In case of guarantee problems, please contact tanala Foto GmbH, Mevissenstr. 62B - building 11, 47803 Krefeld in a written way.
 
8.3 You have to prove the beginning of the warranty period by a copy of your bill. You should keep all documents safely.

8.4 In case of defect articles you are entitled to get subsequent performance. If the customer is a user, he/ she is able to choose between a repair or a replacement of the defect article. The customer has to give detailed descriptions about the choosen kind of repair to tanala-store.com. tanala-store.com can refuse the choosen way of repair if this would be too expensive or if there would be another sufficient way of repairing the article without any disadcantage to the customer.

8.5 A return of articles will be inadmissible if there were no consultation with tanala-store.com. tanala-store.com refuse the return completely if there were no consultation. Furthermore tanala-store.com can, due to reasons of checking warranty claims, demand a return of the complaint about articles from the customer. The return of articles has to be via a insured parcel delivery. The customer has to bear the costs for the return for the moment. If there would be defects, tanala-store.com will reimbuse the costs of the return.

8.6 If tanala-store.com is going to deliver flawless articles in case of subsequent performance tanala-store.com can demand refund of the defect articles from the customer. 
 
8.7 A subsequent performance is unsuccessful if a it could not be carried out twice or if a replacement would fail due to the lack of availability.

8.8 If the customer will cancel the contract due to a failed subsequent performance he/ she will not be entitled to compensation. If the customer will choose to get compensation in case of a failed subsequent performance, the article stays at the customer's if this would be reasonable.The compensation is restricted to the difference between purchase price and the value of the defect article if tanala-store.com did not cause the breach of contract deliberately.

8.9 There will not be any guarantee if a detailed inspection did not detect any damage or in case of damages which were caused by natural wear, improper use or inadequate or wrong upkeep. Furthermore, warranty claims concerning damages which were already mentioned  in the description of the article cannot be asserted.

8.10 If tanala-store.com is going to refuse guarantees according to point 8.9, the articles will be returned to the customer's costs to the customers.
 
8.11 All data about size, weight, colour etc. are approximate values. Deviations due to vagueness of measures are permissible.

9. Reservation of ownership:
 
Delivered articles will belong to tanala-store.com until the bill is paid completely and until all demands, except for demands that will result out of business connections, are erased. If the on reservation of ownership delivered articles will be sold or connected with other objects by the customer, he /she is going to sign over demands at the rate of the value, which will result out of the selling, immediately. We will accept this signing over. 

10. Non-delivery through manufacturers:

(1) If the ordered article is not available, tanala-store.com will inform the customer immediately. Until the delivery through the manufacturer wil be taken place, tanala-store.com will be excused from the delivery duty except for tanala-store.com is responsible for the non-delivery through the manufacturer. tanala-store.com agrees to sign over the claims to the non-delivery against the supplier. 

(2) tanala-store.com will reserve the right of withdrawal a contract for itself in case tanala-store.com has closed a congruent deal to fulfil a customer's contract and if the customer did not stick to the contract's demands. The right of withdrawal will be out of question if tanala-store.com is responsible for the non-delivery through the manufacturer of has taken over a guarantee of delivery. tanala-store.com is committed to inform the customer about the non-availabilty of articles immediately and has to reimburse the customer's consideration at once. If the customer is an entrepreneur, a juristic person under public law or  public-legal special assets, tanala-store.com is entitled to withraw from a contract due to the previous mentioned conditions if the manufacturer is not able to discharge his/ her duty of contracts which are no hedging transactions.
 
(3) Claims for damages are out of question except tanala-store.com is responsible for the non-delivery through the manufacturer.

11. Liability:

The liability is restricted to damages which are committed recklessly or deliberately. The limitation of liability affects contractual and non-contractual claims.

12. 14-day right of return:

You are able to return received articles within two weeks without any details of reasons. The period will start earliest with the receipt of the articles and latest with the receipt of this explanation. Please inform us before returning the articles in a written way to discuss the details of the return (postage and insurance of delivery).

13. Practical law:

For all legal relations of parties the Law of the Federal Republic of Germany to be closed to the EGBGB and the acts about the international purchase of moveable goods is binding.

14. Supplementary clause:

In case of ineffectiveness of  an aforementioned condition the effectiveness of the other conditions will be still valid. The ineffective clause will be replaced by another one mutually which will resemble economically the ineffective clause most.

15.Data security:

The broadcasting of data takes place with the help of a secured connection (reference in accordance to § 33 BDSG): all personal data will be saved by us.

16. Data protection:

Our practice with regard to data prtection is in accord with the Federal Data Protection Act (BDSG) and with the Telecommunications Privacy Act (TDDSG). We will ask for and use your personal data only to deal with your order except you would like to to enlist additional services. to deal with and to deliver your order we will pass on your data only to the delivery service.
